During Hurricane Wilma my house suffered damage that the insurance company refused to pay. I took them to court and they were forced to comply with the insurance policy and the estimates of the value of my claim. In the end, I received a check for close to $80,000 to repay loans that I took out to repair the roof, fence and other property dames.
Now I witness the pain and damage caused by Hurricane Irma down in the Marathon, Big Pine Key, and Key West. I noticed the devastation when I personally, on three different occasions, led the American Legion Post 180 Relief Supplies convoy to bring water, food, paper products and clean up supplies to the lower Keys. I made a commitment to help rebuild the Keys. If you made it down this far in my web page know this......I will fight hard for you and your family to help you rebuild!

After you have buttoned up your home, obtained water and other supplies, and the calm is right before the storm is approaching, here is what you must do.
Get your insurance policy out and have your important documents within reach at any given moment.
Take pictures and videos of the inside and outside of your home. Document that shed and its contents on your land. After the storm it may not be there and you have the burden of proving the loss.
Show how you tried to prevent damage to your property by the actions you took like boarding up windows and tying things down.
Go in the attic and take video and pictures of the inside of the roof showing all the support beams and your plywood roof. This helps to prove that there was no pre-existing damage prior to the storm damage.
AFTER THE DEVASTATING STORM:
Prevent further damages. Cover up with tarps or try to mitigate further damages to the affected portion of your property that incurred damage.
If you have a hole in your roof from a downed tree get a plywood or tarp to cover up the hole from incurring further water damage.
You are going to document your damages as if you are going to trial and showing the judge the extent of your property damage. Take video, pictures, preserve damaged property if its viable, and if you have receipts for certain purchases that were damaged this will support your claim.
FILE YOUR CLAIM! Don’t wait weeks to file your claim for property damages. You should have saved the insurance information to make claims before the storm. Make the claims and send them the evidence of your storm damaged property.
Comply with each demand that the insurance company makes and be patient.
After a major hurricane or wind or water storm the insurance companies in South Florida get millions of claims demanding money for the repairs.
An insurance company will look to stop the bleeding of cash to make its stockholders happy. Some adjusters are just to zealous to please their supervisors and deny claims that should be paid out to the claim holder. #FLKeysStrong
Some of the tactics that they use to stop the bleeding of claims paid out is as follows:
“ I am sorry sir it looks like you do not have a policy with this company.” They will deny that your paid in full coverage does not exist.
They will deny your claim in whole or in part stating that “X” property that was damaged is not covered.
Deny your claim outright.
They will delay working on your claim for no good cause or delay the processing, adjustment, or payment of your claim.
They may make false statements or misleading statements to you.
They could deny to pay you under your policy or strong arm you into a bad settlement regarding your other policy that pays less.
They will say the estimates of repairing your property is inflated, thus undervalue the price of repairs, estimates, offers or payments.
The biggest in my estimate is they will be super sweet on the phone falsely telling you that you DO NOT NEED A LAWYER to resolve your claim.
Requires a signed release of any future claims as a condition of your settlement or payment on; or The check for payment from your insurer or the letter that accompanies it uses terms like “full” or “final” when you reasonably believe that you have a future or additional claim for property loss.
If you encounter any of these tactics or the insurance company’s Adjuster is playing games with your claim and there is a dispute please call me Attorney Gabriel Jose Carrera. If you don’t have the saved funds to do the repairs and the policy money is what you are depending on to complete the repairs.
Then its time to hire an Attorney to fight for you. If you experienced any of the above responses from your insurance provider DO NOT hesitate to contact us for a free, no-risk case evaluation.
